Heard learned counsel appearing for the Petitioner and learned AGP for the Respondents. The learned counsel appearing for the Petitioner, on instructions, states that application made by the Petitioner, a copy of which is annexed at Exhibit "D" to the Petition is still pending before the Divisional Commissioner, Pune along with the application for stay, a copy of which is annexed at Exhibit "E" to the Petition. Learned AGP has no instructions as regards the present status of the applications. 2.

We accept the statements made by the learned counsel appearing for the Petitioner on instructions. In view of the said statements, we dispose of the Petition by passing the following order:

46-ASWP450-15.DOC (a) We direct the Petitioner to appear before the Divisional Commissioner, Pune Division on Monday, 30th November 2015 at 11.00 a.m.;

(b) If the application under sub-section 1 of Section 48 of the Land Acquisition Act, 1894 made by the Petitioner is already disposed of, a copy of the order passed on the said application be provided to the Petitioner; (c) If the said application is not yet disposed of, the Divisional Commissioner shall endeavour to decide the said application as expeditiously as possible and in any event within a period of six months from the date fixed for appearance of the Petitioner before the Divisional Commissioner;

(d) If the application for interim relief is still pending, the same shall be decided within a period of two weeks from 30th November 2015;

(e) All contentions on merits of the application, if pending, are kept open;

(f) The Petition is disposed of on above terms.

(g) All concerned to act on an authenticated copy of this order.
