Heard. This is an application under Section 439 of Cr.P.C. The applicant is arrested on 3.12.2014 in Crime No. 3007/2014 registered at Banda Police Station, District Sindhudurg for the offences punishable under Sections 7, 8, 12, 13(1)(5) of the Prevention of Corruption Act, 1988. 2.

It is alleged by the prosecution that the preent applicant had accepted illegal gratification on behalf of the public servant. The Public Servant who happens to be an Excise Officer, was arrested and was enlarged on bail. The applicant is not a public servant. He has been in custody for more than one month and hence he is entitled to grant of bail.

O R D E R

(i) The application is allowed. The applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount.

(ii) The applicant shall report to the concerned police station as and when called.
