Applicants are apprehending arrest in C.R. No. 493 of 2023 registered with Vairag Police Station, District: Solapur for offences IRESH MASHAL punishable under Sections 306, 323, 504, 506 read with 34 of the by IRESH MASHAL Date:

2025.12.05 15:36:55 +0530 Indian Penal Code.

It is the prosecution's case that the applicants are brother-inlaw of deceased Sharad Gaikwad who committed suicide by hanging himself. It is alleged that due to mental harassment by the applicants, the deceased has committed suicide.

It is contention of learned counsel for applicants that

applicants were on interim relief for two years. Investigation is completed and charge-sheet has been filed. Custodial interrogation of the applicants is not required. Hence, requested to allow the application.

It is contention of learned APP that there was physical and mental harassment by the applicants to the deceased. Due to continuous mental harassment, deceased committed suicide. Considering the allegations against the applicants, their custodial interrogation is required. Hence, requested to reject the application. 5.

I have heard both learned counsels, perused F.I.R. and documents produced on record. There is delay of 6 days in filing the complaint. The incident is of the year 2023. Investigation is completed and charge-sheet has been filed. Considering the allegations against the applicants, their custodial interrogation is not required and I pass following order:

O R D E R

I.

Application is allowed.

II.

In the event of arrest, applicants be enlarged on bail in 493 of 2023 registered with Vairag Police Station, District: Solapur on

furnishing P.R. Bond in the sum of Rs. 20,000/- each with one or two sureties in the like amount.

III.

The applicants shall attend the concerned police station as and when required.

IV.

The applicants shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

Application is disposed of in above terms.
