Applicant is apprehending arrest in C.R. No. 493 of 2023 registered with Vairag Police Station, District: Solapur for offences punishable under Sections 306, 323, 504, 506 read with 34 of the IRESH MASHAL Indian Penal Code.

It is the prosecution's case that the applicant is wife of deceased Sharad Gaikwad who committed suicide by hanging himself. It is alleged that due to mental harassment by the applicant, the deceased has committed suicide.

It is contention of learned counsel for applicant that applicant was on interim relief for two years. Investigation is

completed and charge-sheet has been filed. Custodial interrogation of the applicants is not required. Hence, requested to allow the application.

It is contention of learned APP that there was physical and mental harassment by the applicant to the deceased. Due to continuous mental harassment, deceased committed suicide. Considering the allegations against the applicant, her custodial interrogation is required. Hence, requested to reject the application. 5.

I have heard both learned counsels, perused F.I.R. and documents produced on record. There is delay of 6 days in filing the complaint. The incident is of the year 2023. Investigation is completed and charge-sheet has been filed. Considering the allegations against the applicant, custodial interrogation of the applicant is not required and I pass following order:

O R D E R

I.

Application is allowed.

II.

In the event of arrest, applicant be enlarged on bail in 493 of 2023 registered with Vairag Police Station, District: Solapur on furnishing P.R. Bond in the sum of Rs. 20,000/- with one or two

sureties in the like amount.

III.

The applicant shall attend the concerned police station as and when required.

IV.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

Application is disposed of in above terms.
