Learned Advocate for the petitioners, on instructions, states that the petitioners are defendants in the suit. During pendency of the petition, the substantive suit has been dismissed for non-prosecution; hence, nothing remains to be adjudicated in the present writ petition. However, in case, suit is restored, it shall be open for the petitioners to apply for restoration of the petition.

With this clarification, the writ petition stands disposed of. No costs.
