By the present Writ Petition, the Petitioner impugns notice dated 30th November 2022 issued under Section 107 of the Maharashtra Co-operative Societies Act, 1960 (hereinafter referred to as "Said Act").

Ms. Gaikwad, learned Counsel appearing for the Petitioner fairly states that the recovery certificate under Section 101 of the said Act is issued on 31st May 2022 and the same has not been challenged. By the impugned notice under Section 107 of the said Act further steps are taken to execute the recovery certificate issued under Section 101 of the said 1/1

31 WP 13693.23.doc Act. Therefore no interference is warranted under Article 227 of the Constitution of India.

Accordingly, the Writ Petition is dismissed, however, with no order as to costs.
