The petitioner / original plaintiff is challenging interim order passed by the Courts below rejecting temporary injunction application filed by the petitioner. Since 18 September 2017 there is no injunction in favour of the petitioner. No interference in the impugned order, therefore, is called for.

However, by keeping all contentions on merits raised by the petitioner in this writ petition open to be agitated before the Trial Court at the time of hearing of the suit, the writ petition stands disposed of.

Hearing of the suit is expedited.
