Heard learned counsel for the Applicant. This is an application for deleting name of Respondent No. 3 who has expired and his legal heir i.e. wife is already on record as Respondent No.2. 2.

In view of the assertion made in the application that the proposed legal heir is already on record and since the prayer is only for deletion, sufficient cause is made out. The interim application is allowed in terms of prayer clause (a), (b) & (c). Delay is condoned. The Applicant is permitted to delete the name of Respondent No. 3. Amendment to be carried within a period of two weeks from today in the second appeal as well as in pending interim application/s.
