Heard learned counsel for the Applicant and learned counsel for the Respondent.

By this application, the Applicant is seeking transfer proceeding of P.A. No.1136 of 2023 pending before the Family Court, Pune to Family Court, Solapur.

It is contention of learned counsel for the Applicant that the Applicant stays at Solapur and she is finding difficult to attend the Court dates at Pune. Hence, requested to allow the application. 4.

It is contention of learned counsel for the Respondent that the Applicant stays at Pune and only to harass the Respondent, the present application is filed. If this Court intends to allow the application, the Shantanu S. Dhudum 1/2

47-MCA-503-2024 (C).doc Respondent be permitted to appear before the trial Court through VC, and requested to reject the application.

I have heard both learned counsel.

As per contention of learned counsel for the Applicant, the Applicant stays at Solapur, and the petition filed by the Respondent is pending before the Family Court at Pune. The Applicant is finding it difficult to attend the Court dates at Pune. It is settled principle of law that convenience of the wife has to be considered over the husband, the husband - Respondent can appear though VC before the Family Court, Solapur.

Considering these facts, I pass the following order:

ORDER

i. The application is allowed.

ii. PA No.1136 of 2023 pending before the Family Court, Pune be transferred to Family Court, Solapur. iii. The Respondent can file application before the Family Court, Solapur for appearing through VC.

iv. The trial Court shall consider it on its own merits. 8.
