This is an application for bail filed by the applicant who is arrested in Crime No.3009/2015 registered at Sindhudurg Nagari Police Station for offences punishable under Section 7, 8, 13(1)(d) r/w. 13(2) of the Prevention of Corruption Act. 2.

Shri Khandeparkar, the learned counsel for the applicant has submitted that the applicant is not a public servant and hence the

the provisions of the Prevention of Corruption Act are not applicable to the applicant. It is submitted that the applicant is in custody since 10.12.2015, that the investigation is completed and that the presence of the applicant is no longer required for the purpose of investigation. 3.

The learned APP for the State concedes that the presence of the applicant is not required for custodial interrogation. 4.

Considering the above submission, the application is allowed on the following terms and condition­ i) The applicant Mr. Sandeep Parab, arrested in Crime No.3009/2015 of Sindhudurg Nagari police station, is directed to be be released on bail, on furnishing bail bond of Rs. 25,000/­ ( Rupees Twentyfive Thousand Only) with one solvent surety in the like amount to the satisfaction of the learned Special Judge, Sindhudurg. ii) The applicant shall report to the Investigating Officer, as and when called, for the purpose of investigation and interrogation.

iii) The applicant shall not leave Sindhudurg district till filing of the chargesheet, without prior permission of the learned Special Judge, Sindhudurg.
