The Applicant is apprehending arrest in Crime No.324 of 2024 registered with Vijapur Naka Police Station, Solapur, for the offences punishable under Sections 420, 406 of the Indian Penal Code.

It is prosecution's case that the Applicant had purchased the vehicle of the first informant but neither paid the full purchase price nor returned the amount to the first informant, thereby cheated him.

It is contention of learned counsel for the Applicant that the Shantanu S. Dhudum 1/4

Applicant is on interim relief for more than one year, he has cooperated with the investigation. The Applicant is ready to return the original RC book and original agreement letter to the first informant. The vehicle is in the custody of the first informant. Considering these facts, his custodial interrogation is not required, and requested to allow the application.

It is contention of learned APP that the Applicant did not returned the amount of the first informant and has used the vehicle of the first informant. Considering allegations against the Applicant, his custodial interrogation is required, and requested to reject the application.

I have heard both learned counsel, perused F.I.R. and documents produced on record.

While on interim relief, the Applicant has co-operated with the investigation. Investigation is almost completed. The Applicant is ready to return the original RC book and original agreement executed with the first informant. Considering these facts, custodial interrogation of the Applicant is not required, and I pass following order:

ORDER

i. The Application is allowed.

ii. In the event of arrest, the Applicant be enlarged on bail in connection with C.R. No.324 of 2024 registered with Vijapur Naka Police Station, Solapur, on executing P. R. Bond to the extent of Rs.25,000/- with one or two sureties in the like amount.

iii. The Applicant shall attend the concerned police station as and when required.

iv. The Applicant shall handover the RC Book and original agreement executed between to the first informant through Investigating Officer.

iv. The Applicant shall not contact and/or threaten/influence any witnesses in the present crime.

The application is allowed in the aforesaid terms and is accordingly disposed off.

It is made clear that the above observations are made only for the purpose of granting bail and the Trial Court shall decide the Shantanu S. Dhudum 3/4

case on its own merits in accordance with law and uninfluenced by the observations made in this order.

All the concerned to act on the authenticated copy of this order.
