The Trial Court by the impugned order rejected petitioner's application for appointment of the Court Commissioner in the suit for injunction. In absence of dispute in relation to encroachment or boundary dispute, the Trial Court was justified in rejecting petitioner's application for appointment of the Court Commissioner. Hence, no interference in the impugned order is called for. The writ petition stand dismissed. (AMIT BORKAR, J.)
