Rule. Rule made returnable forthwith. Heard finally by consent of learned counsel appearing for the respective parties.

The question involved in this petition is whether the ban on recruitment imposed by the Government Resolution dated 2nd May 2012 applies to the appointment of Petitioner. The proposal was submitted by the school, however, it was returned on 21st April 2018 without actual verification of it. Hence, the order dated 21st April 2018 is the subject matter of challenge in this writ petition.

In view of the above, writ petition is allowed and the order dated 21st April 2018 is hereby quashed and set aside. The management - Respondent Nos.3 and 4, are directed to resubmit the proposal for verification and examination by the Education Officer (Secondary), Zilla Parishad, Sangli within the period of two weeks from the date of receipt of a copy of this order.

Upon receipt of such proposal from the management, the Education Officer shall take a decision as to the applicability of Government Resolutions to such appointments, if any, made and pass an appropriate order, which shall be communicated to the Petitioner as well as to the management. If the Petitioner is aggrieved by such decision, the challenge is left open.

Rule is made absolute in aforestated terms.
