Learned counsel appearing for the respondents does not dispute that all the pleadings, documents and oral evidence which were forming part of the record before the learned trial Court are already annexed to the second appeal and thus separate paper book is not required.

Learned counsel for the applicant states that if the applicant seeks to rely upon and any other documents, the same can be furnished at the time of hearing of the second appeal. The statement is accepted. The applicant is 82 years old. Hearing of the second appeal is expedited.

The office is directed to place the second appeal in the list of "Expedited matters (Senior Citizens)". Place the matter on board for hearing and final disposal in the week commencing from 25th April, 2016.
