At the outset, learned PP appearing for Respondent-State on instructions submits that presently the petitioner is on emergency parole. It is submitted that after the petitioner surrenders himself, he will be transferred from Kolhapur open prison to Yerwada open prison. The statement is accepted. 2.

The contention of the learned counsel for the petitioner that the petitioner may be retained in Kolhapur open prison has no merits. It is for the respondent to take decision on administrative side, keeping in view the number of inmates in the jail. Hence, no Bhagyawant Punde

In view of disposal of the writ petition, nothing further survives for consideration in the interim application. Hence, the interim application stands disposed of.
