IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.13530 OF 2017 Mrs. Tabasoom Mohamadhanif Kazi .... Petitioner Vs.

The State of Maharashtra & Others ....

Respondents Mr. Y.B. Lengare for the Petitioner.

Ms Rupali Shinde, AGP, for the RespondentState. Mr. Ashok Kadus, Education Officer (Secondary), Zilla Parishad, Sindhudurg, present.

CORAM: S.C. DHARMADHIKARI & M.S. KARNIK, JJ.

DATE : MARCH 06, 2019 P.C:

1.

There is an affidavit in reply filed and the Education Officer (Secondary), Zilla Parishad, Sindhudurg is present in Court.

2.

In this affidavit in reply he says that since the salary grant was not released, the petitioner could not obtain the regular salary and now the arrears are to the extent of

Rs.3,24,000/.

3.

We remind the Education Officer and through him the Department as well that this sum may be nothing for them but for a teacher like the petitioner it means everything. She has been forced to approach this Court not once but twice. The appointment of the petitioner was first approved but later on that approval was recalled. Till the time the approval was in force, the salary was not released, namely, from 2872014 to 2772017.

4.

Now the salary bills have been forwarded by the Management.

5.

Let the amount be credited to the account of the petitioner by 3132019. The amount shall be credited in the Bank account of the petitioner, the details of which are available with her and if not with the Education Officer, he must obtain them from her. Secondly, the Education Officer should go through the past records in the event the Management is not forwarding any fresh proposal for approval and treating our

order and direction as a proposal/request from the Management and thereafter consider the matter of approval to the petitioner's appointment and pass the requisite orders in accordance with law by 3042019. The writ petition is disposed of with this direction. There will be no order as to costs. (M.S. KARNIK, J.) (S.C. DHARMADHIKARI, J.)
