The Applicant was convicted for offence punishable under section 138 of Negotiable Instruments Act and therefore sentenced to suffer simple imprisonment for six months and pay compensation of Rs.1,00,000/-. The Applicant has been unsuccessful in his appeal against conviction and sentence as well. He is therefore before this Court.

Learned counsel for the Applicant makes a statement that the Applicant shall deposit Rs.1,00,000/- with the Trial Court within the time frame of two weeks. It is also informed that the Applicant has already deposited Rs.25,000/- with the Appellate Court. 1/2

In view of the above, substantive sentence of imprisonment to stand suspended, pending the revision application. 4.

The Applicant shall be released on executing P.R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) and Surety Bond in the like amount. If the Applicant fails to deposit Rs.1,00,000/- with the Trial Court within two weeks from the date of this order in trial court, bail granted to him is liable to be cancelled.

The amount already deposited with the Trial Court and that of the Appellate Court be paid to the Respondent-complainant along with interest accrued thereon.

The Applicant be released on P.R. bond immediately. One week's time is granted to furnish surety bond. Bail before the trial court. 7.

Interim Application No.4499/2022 stands disposed of. 8.

List the Revision Application on 14/02/2023 for compliance of the order.
