This is an application for bail filed by the aforesaid Applicant, who was arrested in Crime No.3010 of 2015 registered at Vengurla Police Station, for the offences punishable under sections 7, 13 (1) (d) and 13 (2)of the Prevention of Corruption Act. 2.

Mr. A.S. Khandeparkar, the learned counsel for the Applicant has submitted that the investigation is complete and the presence of the Applicant is no longer required in the custody. He has further submitted that the Applicant is ready and willing to co­operate 1/3

with the investigation and abide by all the terms and conditions imposed by the Court.

Ms Veera Shinde, the learned APP concedes that the investigation is completed. However, she submits that presence of the Applicant may be required at future date for further investigation, if any.

The records prima facie reveal that the Applicant herein had demanded bribe to give permission for re­development of the ancestral house of the complainant. Pursuant to the said complaint trap was laid and the Applicant was caught while accepting the bribe amount of Rs.4,000/­. The Applicant was arrested on 16.12.2015. Investigation in the case is completed and the presence of the Applicant is no longer required for the purpose of investigation. 5.

Under these facts and circumstances, the application is allowed on the following terms and conditions:­ (i) The Applicant is ordered to be released on bail on furnishing bail bonds of Rs.25,000/­(Rupees Twenty 2/3

Five Thousand only) for one or two sureties in the like amount to the satisfaction of Sessions Judge, Sindhudurg at Oras.

(ii) The Applicant shall report to the Investigating Officer as and when required by the Investigating Officer for the purpose of the investigation.

(iii) The Applicant shall not leave Sindhudurg ­District without prior permission of the Sessions Court till filing of the charge­sheet.
