By this Civil Application, applicant/original claimant is seeking condonation of 122 days delay in filing First Appeal challenging the judgment and award dated 30.04.2014 passed by Motor Accident Claim Tribunal, Sindhudurg at Oras in Motor Accident Claim Petition No.43 of 2013.

Considering the submissions made by learned Counsel for applicant, averments made in Civil Application, I am satisfied that the applicant has made out case for allowing this Civil Application. Hence, following order :- a) Civil Application is allowed in terms of prayer clause (a) which reads thus :- "(a) That delay of 122 days in filing the present appeal may be condoned in the interest of justice and kindness For such other order and relief's in the interest of justice and kindness."

b) Civil Application stands disposed of accordingly.

c) No order as to costs.
