In view of the fact that the applicant is already chargesheeted, he is seeking relaxation of condition No.19 of the order dated 26th September, 2022, whereby pre-arrest bail was granted in favour of the applicant.

The relaxation is sought on the ground that the applicant, a social and political activist is required to be present in the village. As the charge-sheet in the matter was submitted on 3rd November, 2022, it is urged that there are no chances of the trial being taken up expeditiously.

Learned APP submits that the applicant has already breached the aforesaid condition, as the station diary records the entry of the applicant in the village without permission of the Court BGP.

We have appreciated the aforesaid submissions. 5.
There is no material on record to substantiate claim made by the APP. However, the fact remains that the applicant appears to have complied with the condition No.19 of the order dated 26th September, 2022 till this date. As applicant is already charge-sheeted, it will be appropriate, in my opinion, to relax the said condition. However, it is made clear that if the applicant is found involved in any other similar offence, the Investigating Agency shall be at liberty to cancel the bail granted to him. As such, the condition No.19 stands deleted.

Applicant shall be at liberty to enter the jurisdiction of the village.

The application as such stands disposed of in above terms.
