In this petition under Article 227 of the Constitution of India, the petitioner has assailed the validity of the order dated 7th October, 2017 passed by the trial Court by which application for referring the issue arising out of the suit under the Maharashtra Prevention of Fragmentation and Consolidation of Holdings Act, 1947 to the Competent Authority has been rejected.

Learned counsel for the petitioner submits that in view of the pursis filed by the parties, the issue have been amicably settled between the parties and settlement deed dated 24th January, 2022 has been executed. He, therefore, seeks leave of this Court to withdraw the petition. 3.

Needless to state that the respondent nos.1 and 2 shall file an application under Order XXIII Rule 3 of the Civil

5-WP-802-2018.doc Procedure Code, 1908 for disposal of the suit in terms of the compromise between the parties.

Accordingly, the writ petition is dismissed as withdrawn. 5.

Let a copy of this order be forwarded to the Trial Court forthwith.
