By this petition under Article 227 of the Constitution of India the Petitioner challenges the common order on Exhibits 45 and 46 dated 08.06.2017 passed by Joint Civil Judge, Junior Division, Panhala.

After arguing for some time, the learned counsel for the Petitioner submits that Petitioner may be permitted to withdraw the present Writ Petition with liberty to take appropriate steps according to law before the Trial Court. To that effect, he has given in writing. Same is taken on record and marked "X" for its Mohite 1/2

920 wp194-18.doc identification. Same is accepted.

The learned counsel for the Petitioner submits that the suit is pending before the Trial Court since 2012. He submits that hearing of the suit may be expedited. Hence, following order is passed:

a) Writ Petition stands disposed of as withdrawn unconditionally with liberty as prayed.

b) Hearing of Regular Civil Suit No. 200 of 2012 pending before the Joint Civil Judge, Junior Division, Panhala, Dist.Kolhapur is expedited.

c) No order as to costs.
