Heard learned Counsel for the Petitioner.

My attention is invited to the impugned order dated 28th June, 2019 passed by the learned Industrial Court. I have gone through the impugned order. Before the Industrial Court, a request was made by the Petitioner for appointment on a compassionate basis with the Respondent- Pandharpur Nagar Parishad, District Solapur. I do not find any reason to interfere with the findings of the Industrial Court. However, with regard to the subsequent events placed on record, the learned Counsel for the Respondent- Pandharpur Nagar Parishad, District Solapur, fairly submitted that Nagar Parishad does not consider this to be an adversarial litigation. 14-wp-641-2020.doc A compilation of documents is placed on record by learned Counsel for the Respondent, indicating that fresh application made by the Petitioner has been responded to and the name of the Petitioner is shown at Sr. No.22 of the waiting list in the communication dated 21st May, 2021 addressed by the Joint Commissioner, Collector Office, Solapur to the Chief Executive Officer of the Respondent. It is submitted by the learned Counsel for the Respondent that in the matter of Petitioner's application for appointment on compassionate grounds, the process will be taken to its logical conclusion.

As a fresh process is underway, obviously, the findings of the Industrial Court will not come in the way of the Respondent's while considering the application made by the Petitioner on its own merits and in accordance with law.

With the above observations, Writ Petition is disposed of with no order as to costs.
