Heard learned counsel for the applicant and learned APP for the State.

This is an application for bail in respect of the offence punishable under Sections 307, 341, 324, 323, 504, 506 read with 34 of the Indian Penal Code (hereafter 'IPC' for short) registered on 05.10.2023 vide C.R. No.223 of 2023 with Patan Police Station, District Satara.

The applicant is the accused No.2. The applicant was arrested on 08.10.2023.

It is the case of the prosecution that three accused assaulted the complainant with the plastic bucket on the 1/3

head of the complainant. Learned APP opposed the application for bail contending that the charge-sheet is yet to be filed and the investigation is in progress. 5.

I have perused the injury certificate. In the facts and circumstances of the present case in my opinion considering the nature of the injuries and taking an overall view of the matter I am inclined to enlarge the applicant on bail. There are no criminal antecedents reported against the applicant. Hence, the following order :-

O R D E R

(a) The application is allowed.

(b) The applicant-Dhanaraj Bharat Patil @ Kadam in connection with C.R. No.223 of 2023 registered with Patan Police Station shall be released on bail on his furnishing P.R. Bond of Rs.25,000/- with one or more sureties in the like amount.

(c) The applicant is permitted to furnish cash bail surety in the sum of Rs.25,000/- for a period of 6 weeks in lieu of surety.

(d) Till the charge-sheet is filed the applicant shall reside outside the jurisdiction of Patan Police Station. 2/3

(e) After the charge-sheet is filed the applicant shall report to the Investigating Officer of Patan Police Station as and when called.

(f) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence. (g) On being released on bail, the applicant shall furnish his contact number and residential address to the Investigating Officer and shall keep him updated, in case there is any change.

(h) The applicant shall attend the trial regularly. The applicant shall co-operate with the trial Court and shall not seek unnecessary adjournments.

The application is disposed of.
