The plaintiff filed an application at Exhibit 70 for recasting of the issues. For the reasons stated in the order dated 05/10/2017 the application was rejected by the Civil Judge, Junior Division, Kadegaon. The application for recasting issues is filed at the stage when the evidence of plaintiff and defendant is over. I am therefore not inclined to entertain this Petition at this stage. The petitioner is at liberty to challenge the order dated 05/10/2017 in Appeal that may be filed against the decree passed in Regular Civil Suit No. 125 of 2010. 1/2
