By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.20 of 2023 registered with Jat Police Station, Dist: Sangli, for the offences punishable under Sections 302 read with 34 of the Indian Penal Code, 1860 (for short, 'IPC').

The applicant is the son-in-law who alleged to have committed murder of his father-in-law.

Having considered the charge-sheet, it is evident that the IO during the investigation has recovered sickle having bloodstains, at varsha

(31)-BA-3688-2023.doc the instance of the applicant. Furthermore, there are eye witnesses to the incident. In addition to the same, statement of a witness recorded under section 164 of Cr.P.C. is there to support the case of the prosecution. The material collected by the IO as regards the motive and evidence connecting the applicant in the alleged offence, make the applicant disentitle for grant of bail.

In the above referred backdrop, the submission of learned counsel Shri Nikam that the charge-sheet has been filed and hence further custody of the applicant is not necessary, cannot be accepted. The offence is very serious and since sufficient incriminating material has been collected by the IO during the investigation showing his prima facie involvement in the alleged offence, the application is rejected.
