Heard.

As per earlier order passed by this court, learned A.G.P. for the State submitted affdavit dated 19.12.2019 duly affrmed by Sadashiv Nivrutti Jadhav, Regional Deputy Director (Sugar), Cooperative Societies, (Sugar), Kolhapur Division, Kolhapur. Same is taken on record.

After considering the Affdavit-in-Reply fled by the State, Petitioner as well as other parties submit that matter can be disposed of by consent of all the parties directing Respondent no.3 to complete the enquiry as per order dated 5.12.2018 under section 11 of the Maharashtra Co-operative Societies Act, 1960 as early as possible but in any case, on or before 15.02.2020. As soon as enquiry is completed by Respondent no.3, Respondent 2/3

no.5 Karkhana be directed to inform the same to Respondent no.4 immediately.

The learned counsel for the Respondent no.5 submitted that they are ready and willing to co-operate with the Respondent no.3 to comply the said order within particular time. Statement is accepted. Hence, by consent, following order is passed:

a.

Respondent no.3, Regional Joint Director of Sugar, KolhapurRegion, Kolhapur is directed to comply the order dated 5.12.2019 under section 11 of the Maharashtra Co-operative Societies Act, 1960 as early as possible but in any case, on or before 15.02.2020.

b.

As soon as enquiry is completed by Respondent no.3, Respondent no.5 is directed to forward list of members to the Respondent no.4.

c.

Rule made absolute accordingly.

d.
