Heard learned counsel for applicant and learned APP. This application is filed for anticipatory bail in Crime No. 527/2017 for the offence under Section 323, 326, 365, 504 and 506 r.w. 34 of Indian Penal Code. The case of prosecution is that on 10th November, 2017 report is lodged by Chintya Kamble, thereafter, on that day at 8.00 pm. Budhaprakash Nanaware and his relative Sanjay Gaikwad took him on the motorcycle near Prabhakar vasti and assaulted him where after assault applicant arrived and also claimed to have assaulted the complainant and got him admitted in the hospital. 2.
According to the applicant's counsel involvement of applicant is totally false in view of the fact that immediately prior to the 1/2
(2)aba215617 incident alleged in the report, applicant's daughter in law had lodged report in the same police station against Chintya Kamble having an evil eye upon her and that on 7th November, 2017, Chintya had provided her his cell phone number on a piece of paper and on one occasion had also attempted to outrage her modesty by committing trespass in her house upon which offence under Section 323, 354A, 354D, 447, 504, 506 of IPC is registered on the basis of report lodged by wife of complainant Budhaprakash Nanaware.

Considering the facts as aforesaid this Court had protected the applicant by interim order having considering involvement of applicant and facts as aforesaid, interim protection granted to applicant by order dated 12th December, 2017 is confirmed. 4.
Application is disposed of as allowed.
