DATED : 19 JANUARY 2023 P.C. :- This is an application under Section 438 of the Code of Criminal Procedure anticipatory bail.

The applicant is apprehending his arrest in Crime No. 683 of 2022 registered at Jath police station for the offences punishable under Sections 420, 406, 465, 471, 468 of the Indian Penal Code. 3.

The applicant was working as a clerk with Umrani Gram Panchayat. The allegations against the present applicant are of cheating, forgery and misappropriation of the amount.

I have heard the learned counsel for the applicant and the learned APP for the respondent-State and perused the statement of witnesses. MJ Jadhav 1 / 2

The modus-operandi of the applicant appears to be after accepting the amount from villagers towards property and water tax, he used to issue fake receipts mentioning the actual amount paid by the villagers towards tax, however, in the original receipt book he used to mention less amount. Prosecution has recorded the statement of 12 witnesses to that effect. Considering the nature of offence, I am not inclined to release the applicant on anticipatory bail.
