The applicant is arrested on 26th August, 2019 in connection with C.R. No. 568 of 2019 registered with Vijapur Naka Police Station, Dist. Solapur for offences punishable under Section 370 (2)

(3) of Indian Penal Code and Sections 3, 4, 5 & 6 of Immoral Trafficking (Prevention) Act, 1956.

The prosecution case is that the first informant is attached to Vijapur Naka Police Station. On 25th August 2019, information was received about prostitution activity conducted at Jagdamba Nagar Jule Solapur area and hence it was decided to conduct the raid by sending dummy customer. Raid was conducted. Three ladies were found in the premises. Their statements were recorded. All of them

were major. They have stated that one or two days before they were brought by the accused. However, before they indulged in prostitution activity, the police had raided the premises. They have not stated that they were forced into prostitution by applicant. 3.

Learned APP submitted that the applicant is involved in the prostitution activity. His brother was conducting the said activity. The applicant was acting as agent. The applicant is in custody from 26th August, 2019. There is nothing on record to show that the applicant was involved in such activity in the past. The victim were major ladies. They have not referred to exploitation by applicant. The police had raided the premises. The victim have stated that two days before they were brought by the accused. In these circumstance, bail can be granted to the applicant on certain terms & condition. 4.

Hence, I pass the following order :

O R D E R

i) Bail Application No. 3596 of 2019 is allowed; ii) The applicant is directed to be released on bail in connection with C.R. No. 568 of 2019 registered with Vijapur Naka Police Station, Dist. Solapur, on furnishing P.R. bond in the sum of Rs. 25,000/-

with one or more sureties in the like amount; iii) The applicant shall report concerned police station once in a month on every first Saturday between 11.00 am. to 1.00 pm. till further order. iv) Application stands disposed of accordingly.
