The Criminal Application No.712 of 2017 for relaxation of Condition No. (ii) and (iii) imposed vide Order dated 14th November, 2017, passed by the Additional Sessions Judge, Pandharpur, whereby, while granting interim bail the conditions were imposed to the effect that the Applicant shall deposit an amount of depositors as per agreement and on failure depositing the said amount, it is observed that the bail granted to the Applicant will automatically stands cancelled. 2.
In view fo the Judgment of the Hon'ble Supreme Court of India in the case of Ramesh Kumar V/s State of NCT of Delhi reported in (2023) 7 SCC 461, such condition is not permissible to be imposed at the time of granting bail. In view of above, the application is allowed.
ORDER
i.
The Condition No. (ii) and (iii) by Order dated 14th November, 2017, passed by the Additional Sessions Judge, Pandharpur are hereby relaxed.
ii.
Accordingly, the Criminal Application No.712 of 2017 is disposed off.
