ORDER (Per Sharmila U. Deshmukh, J.

The Petition challenges the order dated 20th August, 2024, rejecting the proposal submitted by the Petitioner Nos. 2 and 3 seeking approval to the appointment of Petitioner No. 1 as Shikshan Sevak since 16th June, 2017 by listing the deficiencies noted by the Respondent No. 5 in the said proposal.

Mr. Bhavake, learned Advocate for the Petitioners submits that the proposal came to be rejected by merely listing the deficiency and without 1 of

giving an opportunity to cure deficiencies.

Mrs. Deshmukh, learned AGP would draw attention of this Court to the affidavit-in-reply which was filed on behalf of the Respondent No. 5 and would submit that as the error was found in the document and information, the proposal came to be rejected. 4.

In event, there was any deficiency in the proposal and error in the documents the appropriate course to be followed by the Respondent No. 5 was to communicate the said deficiencies to the Petitioner Nos. 2 and 3 and give them chance to cure the same which has not been done in the present case.

We are therefore inclined to direct that the impugned order dated 20th August, 2024, be treated as show cause notice to the Petitioner Nos. 2 and 3 and opportunity be given to the Petitioner Nos. 2 and 3 to cure the deficiencies and submit the necessary documents. The deficiencies to be cured by Petitioner Nos. 2 and 3 within a period of two weeks from today. In event there are any further deficiencies noted by the Respondent No. 5, the same to be communicated to the Petitioner Nos. 2 and 3 expeditiously. Upon considering the material placed on record an appropriate decision be taken by the Respondent No. 5 within a period of 8 weeks from today.

Writ Petition stands disposed of.

In event approval is granted by the Education Officer the Respondent No. 4 to grant Shalarth ID to the Petitioner No. 1 expeditiously.
