This Interim Application is taken out seeking leave to file Second Appeal, as the Applicants who are the heirs of Defendant No.3 are not brought on record in the learned Trial Court. However, as the Appeal was filed by the Appellants before the learned First Appellate Court and the delay condonation application filed in the said Appeal was dismissed by the learned First Appellate Court, which order is inter alia challenged in the First Appeal, leave is not required. Therefore, the Interim Application is disposed of.
