By the above Writ Petition, the Petitioners have impugned the notice dated 6th November, 2019 issued by the Tahsildar, Palus. Admittedly, the Tahsildar, Palus has issued the impugned notice without giving a hearing to the Petitioners. In view thereof, we pass the following order :
(i) The Tahsildar, Palus shall hear the Petitioners on 27th January, 2022 at 12.00 noon and after considering the oral as well as written submissions, if any, pass a speaking order qua the subject issue.
(ii) All contentions of the parties are kept open.
Kanchan P Dhuri 2 / 2 25-WP-6623-2021.odt (iii) The Tahsildar, Palus shall pass his order on merits within a period of six weeks from the date of hearing.
(iv) In the meantime and in the event of the order passed by the Tahsildar, Palus being against the Petitioners, the same shall not be implemented for a period of three weeks from the date of service of the same on the Advocate for the Petitioners.
