1] Prisoner has sent letter dated 10th June 2018 seeking benefit of remission scheme granted on eve of 125th Birth Anniversary of Dr. Babasaheb Ambedkar.
2] Learned APP informs that the benefit of remission scheme is declined because of negative appraisal report submitted by the convicting Court.
3] The conviction of the prisoner is under sections 302, 120B, 364 and 342 of IPC. The norms regulating the grant of remission dated 3rd June 2017 excludes only sections 121 to Dinesh Sherla 1/2
13-cri-wp-5300-18.doc 130 of IPC. Thus, convicts under above sections are entitled to benefit of remission scheme.
4] We, therefore, direct the respondent to extend that benefit to the prisoner, in accordance with law, within next six months from today.
