By this application, the applicant is seeking relaxation of condition No. (iii) imposed on him by this Court (Coram : S. M. Modak, J.) by order dated 23rd April, 2024.

It is contention of learned counsel for the Applicant that by order dated 23rd April, 2024, this court directed the Applicant not to enter the Solapur District till the conclusion of trial. The Applicant is way from his family more than one year. It may take time to conclude the trial. Hence requested to allow the Application.

Considering the submission of learned counsel for the Applicant, learned APP and learned counsel for Respondent No. 2 and considering that the Applicant is away from his family more than one year I pass following order :

ORDER

I.

Application is allowed.

II.

The condition No. (iii) imposed by this Court (Coram : S. M. Modak, J.) by order dated 23rd April, 2024 is hereby relaxed.

III. Applicant Shall not contact the First Informant-Respondent No. 2.

IV.

If there is breach of condition, the Respondent No. 2 can file Application for cancellation of relaxation of condition No. (iii) imposed by this Court by order dated 23rd April, 2024. 4.
