The present writ petition takes exception to order dated 13th October 2023 passed by Presiding Officer, School Tribunal, Kolhapur, in Appeal No.17 of 2022, whereby appeal of Respondent No.1 is allowed by setting aside the order dated 12th May 2022 passed by the Respondent - Management.

During pendency of present petition, petitioner and

respondent No.1 arrived at an amicable settlement and submitted consent terms before this Court. The parties were relegated to Registrar (Judicial) of this Court for verification of consent terms. Accordingly, they appeared before Registrar (Judicial), who has submitted a report of verification affirming that parties have genuinely settled the dispute, voluntarily signed the compromise terms, read the contents of consent terms, and further declared that contents are true, correct, and binding upon them. 4.

The consent terms are taken on record and marked as Exhibit - 'X' for identification.

The parties have agreed that impugned order dated 13th October 2023, passed by learned Presiding Officer, School Tribunal, Kolhapur, in Appeal No.17 of 2022, shall be ineffective and shall be treated as quashed and set aside. Respondent No.1 has accepted that she was/is working on the post of Assistant Teacher and gives up her claim on the post of Head Mistress. She agreed to work as an Assistant Teacher in Respondent No.5 - Secondary School. Parties have withdrawn the allegations made against each other.

The impugned order passed by learned Presiding Officer,

School Tribunal, Kolhapur, in Appeal No.17 of 2022 is accordingly quashed and set aside.
