CORAM:
M.S. Sonak & Jitendra Jain, JJ.
DATED:
06 May 2025 PC:- 1.
Mr. Bhavake, learned Counsel for the Petitioners states that the Petitioners will be satisfied if directions are issued to the Respondents to complete the acquisition process which, they claim, they have initiated within the shortest possible time. 2.
In the affidavit-in-reply filed on behalf of the Respondent Nos 1 to 3, it is stated that land acquisition process is in progress. But the affidavits refer to negotiations. Negotiations do not seem to be possible. Therefore, we direct the concerned Respondents to initiate and complete the land acquisition process in respect of the lands in which the Petitioners claim interest as expeditiously as possible and in any event within one year from today. The completion of the acquisition process would include making of an Award and paying the compensation amount.
26-WP-14898-22.DOCX 3.
If the Petitioners are not satisfied with the compensation determined, they will have liberty to accept the compensation under protest and apply for enhancement in accordance with law.
4.
The Respondent No. 3 is directed to file a compliance report in this Court by 30 April 2026 by giving an advance copy to the learned Counsel for the Petitioners.
5.
Regarding the prayer for rental compensation, we grant the Petitioners liberty to represent to the Respondents for payment of the same.
6.
Mr. Bhavake states that such representation will be made within four weeks from today. If such representation is made, the same should be disposed of in accordance with law. 7.
The Petition is disposed of with the above directions but no order for costs.
8.
All concerned to act on an authenticated copy of this order.
