The substantive challenge in this petition is to the show cause notice calling upon the petitioner to show cause as to why disciplinary proceeding should not be initiated against him under the Maharashtra Civil Services (Discipline and Appeal) Rules, 1979. The contentions which are raised in the petition can be always raised by way of reply to the show cause notice. Prayer (b) cannot be granted inasmuch as it is for the concerned authorities dealing with the promotion to consider in accordance with law whether the case of the petitioner should be considered for promotion.
