The Education Oicer (Secondary) is directed to decide the representations dated 16th January 2023, 10th March 2023, 15th March 2023, 25th May 2023 and 11th July 2023 (which are at Page Nos. 128 to 134), pending before the respondent No.3 - Education Oicer (Secondary), Zilla Parishad, Solapur within a period of 10 weeks from the date of communication of this order.

It is made clear the Management shall ensure that all the necessary information in support of such representation will be Uday S. Jagtap 1 of

927-3642-2024-CWP=.doc furnished to the Education Oicer (Secondary). The petitioner to produce copy of this order before the Education Oicer (Secondary) on 18th December 2025 at 11.30 a.m. The petitioner also to produce copy of this order before the Management. If necessary information is required by the Education Oicer from the Management, the Management to co-operate.

Prima facie, we are satisied that the present petition is squarely covered by the decision of this Court in case of Nilesh S/o Namdev Gurav & Ors. Vs. The State of Maharashtra in Writ Petition No. 4748 of 2019 along with other connected petitions, decided on 1st October 2021 (Coram: R.D. Dhanuka & R.I. Chagla, JJ). 5.

Needless to mention that Education Oicer shall pass necessary orders after considering the said decision.

The orders passed by the Education Oicer, shall be subject to the outcome of the SLP, which is pending before the Hon'ble Supreme court against the order passed in Nilesh S/o Namdev Gurav & Ors. (supra).

The Writ Petition is disposed of.
