This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 223 of 2022 registered at Palus Police Station, Sangli for the offences punishable under Sections 420, 467, 468 r/w. 34 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The bail is sought on the ground of parity. In support of the said ground, the learned Counsel for the applicant has placed on record an Kanchan P Dhuri 1 / 2

6-BA-3875-2022.odt order passed by the Sessions Court dated 2 November 2022 in Criminal Bail Application No.1030 of 2022. By the said order, the Sessions Court has released co-accused Shahin Mulani on bail. 5.

I have perused the charge-sheet. According to the prosecution, the present applicant and other co-accused cheated the complainant to the tune of Rs.11 lakhs on the false pretext that they would get him employed in Indian Railway. The role attributed to co-accused Shahin Mulani and the present applicant appears to be identical. In that view of the matter, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Saurabh Shravan Patil be released on bail in Crime No. 223 of 2022 registered at Palus Police Station, Sangli for the offences punishable under Sections 420, 467, 468 r/w. 34 of Indian Penal Code, on furnishing P.R. Bond in the sum of Rs.30,000/- with one or two sureties in the like amount.

(iii) The applicant shall attend the concerned police station once in a month i.e. on first Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of trial.
