By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Sessions Case No.357 of 2023 pending before Additional Sessions Judge, Solapur arising out of Crime No.5 of 2023 of Anti Terrorism Squad, Kala Chowki Police Station, Mumbai for the offences punishable under Sections 489A, 489B, 489C, 489D, 201 r/w 34 of the Indian Penal Code. 3.

The allegations in the FIR are of finding counterfeit currency in possession of Applicant and recovery of hard disk and laptop used in the alleged offence from the house of Applicant. MANISH SURESHRAO THATTE Date: 2024.07.01 15:41:19 +0530 MANISH SURESHRAO THATTE 4.

The maximum punishment in the present matter would be life imprisonment if the offence is established and Applicant is convicted. 5.

In the circumstances the submission of learned counsel for Applicant that since charge sheet is filed after completion of

2 of 2 32.BA.3902.2023.doc investigation, further custody of the Applicant is not necessary, cannot be accepted. Moreover, it is submitted that there is no sufficient evidence available on record to show that the Applicant is involved in the alleged offence.

Contrary to the above submission, learned APP has pointed out that the counterfeit currency of Rs.100/- was recovered from the possession of Applicant along with hard disk and laptop which was used in the alleged offence. In the hard disk and laptop the material relating to commission of offence was recovered and a panchanama was prepared.

In the circumstances since there is prima facie material available on record to show involvement of Applicant in the alleged offence, I am not inclined to grant bail. The Bail Application is rejected.
