Heard the learned counsel for the petitioners. In view of the subsequent developments, the learned counsel for the petitioners, on instructions of the petitioner No.1, who is present in Court, seeks permission to withdraw the petition with liberty to file an appropriate application before the trial court so as to carry out the necessary amendment to incorporate pleadings and prayers to address the developments, which have occurred during the intervening period. 24-wp-14030-2018.doc In view of the aforesaid submission and the developments in the intervening period, the petition stands disposed of as withdrawn with liberty as prayed for.
It is necessary to note that in Miscellaneous Civil Appeal No. 153 of 2018, the learned District Court1, Satara, while dismissing the appeal, has directed the trial court to decide the suit on merits within three months from the date of the order passed in appeal, i.e., 23rd November 2018. The said stipulation of time limit for disposal of the suit by the trial court may now be reckoned from the date of communication of this order to the trial court.
