In Crime No. 204 of 2017 for an offence punishable under Sections 406, 409, 417 & 420 read with Section 34 of the Indian Penal Code and Sections 3 and 4 of the Maharashtra Protection of Investors and Depositors Act, the Applicant is seeking regular bail. After the arrest of the Applicant on 29th December 2017, the Applicant came to be chargesheeted.

The learned Counsel for Applicant submits that the main accused in the crime in question were already ordered to be released by

2/3 Yadav 6.ba.3227.18 this Court on 19th December 2018. According to him, the role attributed to the Applicant is that of a Senior Executive who was entrusted with the work of appointing Agent for collection of the deposits. 3.

The co­accused Vishal Dattatray More, who was a Branch Manager at Solapur along with other co­accused is already ordered to be released. The allegations against the Applicant are comparatively of less gravity as that of the Accused Vishal More.

That being so, a case for grant of bail is made out. Hence, the following order.

ORDER

(A) The Applicant be released on bail in Crime No. 204 of 2017 for an offence punishable under Sections 406, 409, 417 & 420 read with Section 34 of the Indian Penal Code and Sections 3 and 4 of the Maharashtra Protection of Investors and Depositors Act on executing PR Bond of Rs.25,000/­ with one or more sureties in the like amount.

3/3 Yadav 6.ba.3227.18 (B) After the release of the Applicant, he shall attend the Fouzdar Chavdi Police Station, Solapur on every 1st Monday of the month between 10.00 a.m. and 1.00 p.m. till conclusion of trial. (C) The Applicant shall neither tamper the evidence of prosecution nor influence the prosecution witnesses.
