Challenge in this writ petition arises out of proceedings under section 148 of the Maharashtra Land Revenue Code, 1966. 2.

The Minister, by the impugned order, relegated parties to get adjudication regarding their status through the Civil Court by instituting proper proceedings for adjudication of their rights. The learned advocate for the petitioners states that the respondent Nos.1 and 2 have already instituted proceedings for declaring them as heirs and legal representatives of deceased Durgaram Govind Pantoji by filing Miscellaneous Civil Application No.5 of 2019. The petitioners are party to such proceedings. 3.

Therefore, the rights of both the sides will be governed by

15-wp16379-2023.doc the adjudication in Miscellaneous Civil Application No.5 of 2019. Hence, by clarifying that the decision by the Civil Court shall bind both the sides, the writ petition is disposed of. No costs. (AMIT BORKAR, J.)
