Though respondent is served, none entered appearance. 3.

By this application the applicant seeks transfer of divorce petition filed by the respondent/husband i.e. Petition No. 33 of 2023 filed under Section 13(1)(i-a) of Hindu Marriage Act pending before the Family Court at Latur to Family Court at Solapur.

The applicant married the respondent on 29.03.2019 as per Hindu rites and rituals in Solapur. The applicant due to certain matrimonial disputes is residing with her parents at Solapur. She has no source of income and she is dependent upon her family. She further submits that she has initiated proceedings under Section 125 of Cr.P.C. before the Family Court, Solapur so also applicant had filed D.V. proceedings at Solapur. She 1/2

S.S.Kilaje 14-MCA-413-23.doc further submits that her husband is attending the proceedings at Solapur. The applicant has also filed an application for restitution of Conjugal Right in Family Court at Solapur. The applicant thus submits that all the proceedings can be tried at one place at Solapur and that it would be inconvenient for her to attend the proceedings initiated by the husband in Latur. She further submits that respondent/husband is employed as a police constable.

Considering the fact situation and taking into consideration that the applicant/wife is depending upon her parents and that there are three proceedings initiated at Solapur and husband is attending those proceedings, it would be convenient if the proceedings filed in Family Court at Latur are also transferred to Family Court at Solapur. 6.

In view of the same, present Misc. Civil Application is allowed in terms of prayer clause (b). The prayer clause (b) reads as under : "b. That this Hon 'ble Court be pleased to transfer the hearing of Petition A No. 33 of 2023 filed by the Respondent herein, pending on the file of the Ld. Family Court at Latur to the file of Ld. Family Court at Solapur having similar jurisdiction to try and entertain the same." 7.

The application is disposed of.
