Applicant apprehends arrest in C.R. No. 574 of 2023 registered at Islampur Police Station, Pune, for the offences punishable under Sections 370, 370(2), 370A(2) read with Section 34 of the Indian Penal Code, 1860 (for short "IPC") and Sections 3, 4, 5 of the Immoral Traffic (Prevention) Act, 1956. 2.

It is prosecution's case that the Applicant and co-accused were running a brothel at Sai Lodge. The allegations against the Applicant is that he is the owner of the said lodge and running the Shantanu S. Dhudum 1/3

brothel there. The police conducted a raid at the said lodge by sending a decoy customer and they found one lady along with a decoy customer in the said lodge.

It is contention of learned counsel for the Applicant that investigation is completed in the present crime. The charge sheet has been filed against the Applicant. Matter has been committed to the Court of Sessions. The Applicant is on interim relief for more than one year and has co-operated in the investigation. Hence, requested to allow the application.

It is contention of learned APP that the Applicant was running brothel in his lodge. The police raided in the said lodge. They found one lady along with a decoy customer. There is involvement of the Applicant in the crime. Hence, custodial interrogation of the Applicant is required, and requested to reject the application.

I have heard both learned counsel. Perused FIR and documents produced on record.

The charge sheet has been filed against the Applicant and matter is committed to the Court of Sessions. It shows Shantanu S. Dhudum 2/3

that investigation is completed in the present crime. The Applicant is on interim relief for more than one year and has co-operated in the investigation. Considering this fact, his custodial interrogation is not required, and I pass following order:-

ORDER

i. Application is allowed.

ii. The order dated 12th December, 2023 passed by this Court (Coram: N. J. Jamadar, J.), is hereby confirmed.
