Heard Mr. Hase, learned counsel appearing for the Petitioner and Mr. Patil, learned counsel appearing for the Respondents.

By the present Writ Petition fled under Article 227 of the Constitution of India, the Petitioner-husband has challenged the legality and validity of the order dated 1st December 2018 passed by the learned Civil Judge, Senior Division, Kolhapur below Exh.11 in Hindu Marriage Petition No.396 of 2017. By the said order, the Petitioner has been directed to pay to the Respondentwife an amount of Rs.7,000/- per month and Rs.3,000/- per month to the daughter towards their interim maintenance.

A learned Single Judge by order dated 10th July 2019 stayed the said order dated 1st December 2018 on the condition that the Petitioner deposits entire awarded amount upto date in the Trial Court on or before 31st July 2019. By the said order, it has been further directed that failure to comply with said direction, will result in dismissal of the Writ Petition without reference to the court.

Apart from the above aspects, perusal of the impugned order clearly shows that no interference by this Court under Article 227 of the Constitution of India is warranted. 5.

Accordingly, the Writ Petition is dismissed, however, with no order as to costs.
