The petitioner (original defendant) are challenging the judgment and orders passed by the Courts below granting injunction against the petitioner restraining him from disturbing petitioner's enjoyment of road. The order of injunction is in force against the petitioner since 2nd January 2018. Therefore, no interference is called for.

Hence, keeping all contentions raised by the petitioner open to be agitated before the Trial Court at the time of hearing of the suit, the writ petition stands disposed of.

The Trial Court shall decide the matter on its own merits uninfluenced by the observations made in the impugned order. (AMIT BORKAR, J.)
