Learned Counsel for the Respondent Nos. 3 and 4, on instructions, fairly submits that the amount of earned leave encashment of Rs.28,44,010/- as per the government norms which has been deposited in this Court can be permitted to be allowed to be withdrawn by the Petitioner.

Accordingly, the Petitioner is permitted to withdraw the amount of Rs. 28,44,010/- deposited in this Court along with interest, if any, accrued thereon. The Registry to do the needful expeditiously. Learned Counsel appearing on behalf of the Management submits that the aforesaid statement has been made on the instructions of Dr. Parasharam Bhimrao Patil, Director of Mouni Vidyapeeth, Gargoti, who is present in the Court.

Learned Counsel for the Respondent Nos. 3 and 4 submits that the Petitioner during his tenure as a Principal as well as Director of Respondent No.3, has committed certain misconducts for which they want to initiate departmental disciplinary action against the Petitioner. 4.

It it is the submission of the learned Counsel for Respondent Nos. 3 and 4 that there is any breach of the statutory provisions / disciplinary rules which is a misconduct, it is for the Management to take appropriate action against the retired employee in accordance with law. 5.
